A société par actions simplifiée under French law named “NEXX360” (hereinafter “NEXX360”, “we”, “us”, “our”), whose registered office is located at 144 avenue Charles de Gaulle, 92200 Neuilly-Sur-Seine, with a share capital of 10. 000 euros, registered with the RCS of Nanterre under the number 891 857 674, publishes the NEXX360 header bidding solution, hereinafter the “Solution” or the “Platform” having the capacity of data controller or co-responsible controller within the meaning of the regulations on personal data, in particular the General Regulation (EU) 2016-679 on the Protection of Personal Data (RGPD) for all processing of Users’ and Visitors’ personal data carried out via the Solution.
“Solution” or “Platform” or “Site” refers to the solution and the site www.nexx360.io.
“Services” refers to all of the functionalities made available to Visitors and Users of the Solution.
“Account” refers to an account created by a User allowing him/her to access NEXX360’s services.
“User” refers to any Internet user who has created an Account on the Site.
“Visitor” refers to any Internet user browsing the Site.
1.PROCESSING OF PERSONAL DATA OF USERS AND VISITORS BY NEXX360
1.1. Personal data collected by NEXX360
The personal data collected and processed varies according to the services used, your choices and the configuration of your terminal.
Personal data is any information relating to an identified or identifiable natural person.
Creation of a Member Account by the User
In the context of the use of the Platform and marketing activities (e.g. sending newsletters), NEXX360 collects, processes and uses personal data. The data is entered directly by Users when creating an Account.
In order to create an Account, the User must fill in the following mandatory information :
- First name
- Email address and password
- Phone number
- Company name
- Intra-community VAT number
If the User does not wish to communicate his personal data (except for optional data), he is informed that he will not be able to open an Account on the Platform and he will not be able to request services. The User also undertakes to keep their personal data up to date without delay with NEXX360.
Optional information may be completed by NEXX360 through public sources. These same sources may be used to collect personal data for commercial prospecting purposes.
Information collected automatically
When an Internet user consults or uses one of its proprietary websites, NEXX360 may collect certain information automatically. This information may include connection identifiers (see above), IP addresses, unique IDs, domain(s) and the pages, keywords and links visited, the type of device used, the language set in the browser and other technical information. Some of this information may be collected using cookies or other tracking devices.
Any User or Visitor may contact us via a contact form on the Site. To do so, they must provide their email address so that we can respond to their request.
If the User or Visitor does not provide us with their email address, they will not be able to contact us via the contact form.
1.2. Purposes of processing carried out by NEXX360 and legal bases
We use the personal data of Users and Visitors for the following purposes :

Where the processing is based on the consent of the User or Visitor, the latter are informed that they may withdraw their consent at any time.
These data are subject to the following processing operations :
- Collection and hosting in third party software (CRM),
- Consultation by NEXX360’s sales, legal and marketing teams,
- Modification, archiving or destruction.
1.3. Sharing of personal data with other Users
Your data will be processed by NEXX360. They cannot be transferred or made accessible to any third party, except :
- Service providers who support our activity for exclusively technical or logistical reasons (site hosting and maintenance service providers, sending newsletters or other e-mails).
- Any restructuring of our company, including total or partial disposal of assets, mergers, absorption-acquisitions, spin-offs and more generally any reorganisation operation.
Finally, NEXX360 may communicate your data to third parties when such communication is required by law, a regulatory provision or a judicial decision or if such communication is necessary to ensure the protection and defence of its rights.
1.4. Retention period of personal data
The data relating to your registrations and requests will be kept by NEXX360 for a period not exceeding the applicable legal prescription periods referred to below.
We will delete the personal data we collect after a certain period of time:
- Personal data of a User: deletion three years after his last connection to his Account or after his last contact with us ;
- Personal Data of a Visitor collected through cookies or other tracers, subject to consent: deletion 13 months after our last contact with the Visitor.
Before definitively deleting a User’s or Visitor’s Personal Data, we will send an email to the User or Visitor to offer him/her to continue to keep his/her Account active or to continue to send him/her a newsletter to which he/she has subscribed.
1.5. Right of Users and Visitors
In accordance with the regulations in force, Users and Visitors have the right to access and rectify data concerning them, to oppose the processing and to obtain the limitation or portability of such data insofar as this is applicable. They also have the right to define guidelines for the storage, deletion and communication of their personal data after their death.
Users and Visitors may exercise their rights by :

- By writing an email to : firstname.lastname@example.org
Proof of identity may be requested.
In addition, Users and Visitors may at any time request to no longer receive our electronic communications by using the hypertext link provided for this purpose in each email that the Site addresses to them.
NEXX360 takes data protection very seriously, and deploys all the means at its disposal with the aim of transparency and proper management of personal data. It is notably for this reason that Nexx360 has decided to appoint a Personal Data Protection Officer. The latter can be contacted at email@example.com.
If, despite all this, the user is not satisfied with the response provided, he or she has the right to refer the matter to the Commission Nationale Informatique et Libertés (CNIL), située 3 Place de Fontenoy, TSA 80715, 75334 PARIS CEDEX 07.
1.6. Third party sites
We have adopted physical, electronic and administrative security measures including the use of extensive firewalls and passwords to secure access to personal data. In addition, we restrict access to personal data to those employees who need to know that information in order to operate, develop or improve the Site’s services.
1.9. Public Authority
We may be required to disclose personal data to legally authorised bodies and authorities in the context of an investigation into illegal activities that may engage our responsibility, the responsibility of the User or Visitor or the responsibility of another User of the Site.
2. LES COOKIES DEPOSITED ON USERS’ AND VISITORS’ TERMINALS
2.1. What is a cookie ?
The term “cookie” covers all traces deposited and read, for example, when consulting a website, reading an e-mail, installing or using software or a mobile application, regardless of the type of device used, such as a computer or smartphone. The purpose of a cookie is to collect information relating to the Internet user’s browsing and to send him/her services adapted to his/her device.
2.2. How long does a cookie last ?
With the exception of technical cookies, the recording of cookies on a User or Visitor’s terminal requires his consent. By continuing to use the Site after seeing the cookies banner displayed on the Site’s home page, the User or Visitor consents to the recording of cookies on his terminal. This consent is valid for a period of 13 months.

The use of the Site leads to the installation, by NEXX360 or by third parties, of cookies on the User’s or Visitor’s terminal for various purposes as described below :
These are cookies that are essential for browsing the Site (such as the User’s Member Account connection identifiers) which enable the User or Visitor to use the main functions of the Site and to secure his connection. For example, they allow the User to directly access reserved and personal areas of the Site, thanks to identifiers or data that he may have previously provided. If the User or Visitor decides to deactivate these cookies, his browsing experience may be limited and he may not be able to use all the Site’s functionalities.
Cookies for browsing analysis
These cookies record information relating to navigation on the Site in order to enable NEXX360 to know, for example, the number of pages displayed by the User or Visitor.
Sharing cookies (social networks)
The User or Visitor has the possibility to share content from the Site with others via various social networks, such as Facebook or Twitter. When the User or Visitor uses these share buttons (for example: “share” or “like”), a third party cookie is installed. If the User or Visitor is already connected to the social network when browsing the Site, the share buttons allow the User or Visitor to link the content consulted to his Member Account.
These are cookies used to present Users and Visitors with advertisements or to send information adapted to their centres of interest on our Site or outside our Site during their browsing on the Internet. In particular, they are used to limit the number of times the User or Visitor sees an advertisement and to help measure the effectiveness of an advertising campaign. NEXX360 informs the User and the Visitor that some third party companies may use their own advertising tool on the Site. These third party companies may use cookie and tagging technologies to collect information to measure the effectiveness of advertisements.
2.4. How to disable cookies ?
Setting cookies on the Site
We offer Users and Visitors the possibility of accepting or refusing the cookies deposited via the Site by type of cookie, by the means set out below. You can at any time access your settings for managing cookies and other tracers by clicking here.
Please note that if you deactivate all cookies issued by our site, this action will neutralise the cookie deposited in order to record your consent or refusal. This therefore amounts to a reset of your parameters and implies that you have to express your choice in terms of Cookies again.
The User or Visitor may also deactivate all cookies by setting their Internet browser. However, the deactivation of cookies may prevent a User or Visitor from taking full advantage of the functionalities of our services. In particular, a User’s username and password will no longer be stored on the Site.
